Purchasing an Existing Business for a Visa or Green Card
The purchase of an existing business can be used to acquire an L-1, E-2, or EB-1c visa. Each of these categories have different requirements regarding the business size, number of employees, and earnings.
An EB-1c visa, which grants a green card, is the most popular visa when acquiring an existing business. L-1 and E-2 visas also can qualify, and in fact their requirements are lower than for the EB-1c. To qualify for the EB-1c, the following requirements must be met:
- The foreign business must meet certain requirements regarding the number of its employees, internal structure, and earnings.
- The purchase price of the U.S. business is not important for immigration purposes.
- The U.S. company has been actively conducting operations for more than one year.
- The U.S. business must have at least 8 full-time employees (preferably more), 2 of whom are managers with a higher education.
- The U.S. company should have at least $60,000 in net profits from the previous year.
